These are the terms on which Virda provides tags and the software behind them. They are written to be read, and they include a section on what Virda cannot do — because you should know that before you buy, not after.

Who this is between

These terms are between Virda and the business that holds a Virda account. If you are agreeing to them on behalf of a company, you confirm you are entitled to do so.

Members of the public who tap a tag are not party to this agreement. What happens on a tag page is between them and the business whose tag it is.

What Virda provides

NFC tags, programmed and assigned to your account before they reach you, and a web application for configuring what happens when someone taps them and for reading what they send back. There is nothing for you or your customers to install.

We build the templates behind your tags. You configure their content — your phone number, your documents, your information — but not their structure. If you need something the templates do not do, ask us and we will build it.

Your account

We create accounts; there is no public sign-up. Keep your credentials to yourself and tell us promptly if you think someone else has them. You are responsible for what is done through your account.

The tags themselves

Tags you buy are yours. Each carries a fixed web address written before we ship it, and you never need to write to a tag again — what it does is changed from your dashboard, and the sticker on the wall stays as it is.

NFC tags are physical objects. They can be removed, damaged, painted over or covered by metal, and none of that is something the software can detect. Where a tag is recorded as being on a floor plan, that position is a note somebody made, not something the tag senses — if the tag is moved, the record is wrong until a person corrects it.

Your content, and your responsibility for it

Anything you put on a tag is yours and remains yours. You are responsible for:

  • Having the right to use what you upload — documents, images, floor plans, logos.
  • What your tags ask the public for, and telling them why. If you collect names, contact details or photographs, that is your collection and you need a lawful basis for it.
  • Keeping information current. A tag showing an out-of-date manual or a service record that no longer matches reality is a problem only you can see coming.
  • Not using Virda for anything unlawful, or to track people without their knowledge.

We can remove content or suspend an account that is being used unlawfully or that puts other people at risk. We would tell you why.

What we do not promise

Virda depends on hardware and networks we do not control, and it is better that you know the edges before you commit.

  • Not every phone taps. NFC support varies by device, operating system and settings, and some phones need the screen unlocked or a particular gesture. Every Virda tag also carries a QR code to the same address for this reason, but we cannot guarantee any specific phone will read any specific tag.
  • Indoor position is approximate at best.Where a tag shows a floor plan, a phone's own location indoors is often accurate only to tens of metres, and sometimes not available at all. We show that uncertainty honestly rather than hiding it. This is not a safety or emergency location system and must not be used as one.
  • We do not guarantee uninterrupted service. We aim to keep everything running and to fix problems quickly, but we do not offer a formal uptime guarantee, and we depend on third parties for hosting and email.
  • We are not a system of record for compliance. Service and inspection records in Virda are genuinely useful and we take their accuracy seriously, but if a regulator requires a specific certified system, check that Virda satisfies it before relying on it.

Fees

Pricing depends on how many tags you are running and what we build for you, and is agreed with you directly rather than published here. Fees are payable as set out in your quotation. We will give reasonable notice before changing what you pay.

Ending it

You can stop using Virda at any time. Ask us and we will give you a copy of your data in a usable format before anything is deleted — your service records in particular are yours, and we are not going to hold them hostage.

If an account is closed, tags stop resolving and anyone tapping them sees a plain out-of-service page rather than an error.

Liability

Virda is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit, or for anything arising from a phone failing to read a tag, a location reading being inaccurate, or a tag being physically removed or damaged.

Nothing here limits liability that cannot lawfully be limited, including under the Consumer Protection Act where it applies. Where liability can be limited, ours is capped at what you paid us in the twelve months before the claim.

Changes and governing law

If these terms change in a way that materially affects you, we will tell you rather than quietly updating the date at the top.

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
